Here's where the difference comes in for licensing.
When you're using something for personal use, usually you're fine. But how you define "personal use" is not always clear, especially on the public internet, and if a copyright holder has an issue with how you're using it that way they're probably going to make legal trouble for you. That's not fun., and it's up to you whether you want to run the risk.
You might escape notice forever and be fine, but usually using someone else's copyrighted images on your own site isn't a good idea and I wouldn't recommend it.
If you're making money on your own site or distributing the copyrighted images (like as a public extension posted here or on packagist), then you're definitely violating the terms and you just shouldn't attempt this.
There are other emojis on the internet that can be used like this. Search for "open source" or "royalty free" images to find them.
